Privacy Policy

How EQSeer LLC collects, uses, discloses, and protects personal data through our website, the EQ-Seer mobile app, the EQ-Seer web portal, and Bob AI.

Scope note. This Policy covers personal data processed when you visit our website, use the EQ-Seer app, or interact with Bob AI as an individual. When EQSeer processes personal data as a data processor or service provider on behalf of your organization ("Customer") — for example, the business data your organization submits into the Service ("Customer Data") — other privacy terms, such as the contractual agreements between EQSeer and Customer (including the Master Subscription Agreement), may apply instead of this Policy. Where you are an Authorized User with questions about how your employer's data is handled, contact your organization first.

1. Who We Are

EQSeer LLC ("EQSeer," "we," "us," "our"), N9382 Varsity Lane, Appleton, WI 54915, USA, provides the EQ-Seer platform, mobile and web applications, and the AI assistant Bob AI (collectively, the "Service"). For personal data covered by this Policy, EQSeer is the controller (GDPR/UK GDPR) or business (CCPA/CPRA). Our privacy contact is privacy@info.eq-seer.com.

EU/UK representative: EQSeer LLC is a U.S. company with no legal entity or physical presence in the EEA or UK. Having no European presence does not prevent EQSeer from having Customers or Authorized Users located in Europe — GDPR/UK GDPR do not require a company to establish an office, subsidiary, or other legal entity in Europe in order to do business with individuals or organizations there. However, if EQSeer offers the Service to individuals in the EEA or UK, or monitors their behavior there, Article 27 of the GDPR/UK GDPR requires appointing a representative established in the relevant territory — a distinct, separate concept from having a European entity. This representative is typically a third-party representative service engaged under a paid service contract (not a subsidiary or office of EQSeer's own), acting as a local point of contact for supervisory authorities and data subjects. EQSeer has not yet appointed one because it does not currently have material EEA/UK usage; if that changes, EQSeer will engage such a service and publish the representative's name and contact details here. Until then, EEA/UK individuals may contact privacy@info.eq-seer.com directly.

We do not intend to collect special-category or sensitive personal data through these activities beyond account log-in credentials, which CPRA treats as sensitive. Please do not submit sensitive information beyond what is necessary for your use of the Service.

3. Camera, Microphone & Media Capture (Planned — Not Yet Available)

Not currently available. Camera- and microphone-based features are on our product roadmap and are not part of the Service today. The EQ-Seer mobile app and web portal do not currently request camera or microphone access and do not collect audio, video, photos, or voice-search data. This section describes what we expect to collect if and when this feature is released, so you know what to expect in advance. We will update this Policy, request the applicable device permissions, and provide notice before any such feature becomes active.

Once released, we expect the EQ-Seer mobile app to request access to your device's camera and microphone to support two planned features:

Planned activation and control. When released, these features are expected to operate only after you grant operating-system camera/microphone permission and explicitly activate the feature (tap-to-talk or tap-to-record) — never background or always-on listening or recording — with captured media uploading only when you choose to upload it, and permission revocable at any time in your device settings. This feature is planned for the mobile app only; the web portal is not expected to request camera or microphone access.

Once available, media you capture may contain your own personal data and, incidentally, the personal data of third parties or bystanders present in a recording. Your organization would be responsible for establishing a lawful basis and providing any required notices to individuals whose personal data is captured, and you would be responsible for complying with applicable recording, wiretapping, and consent laws — see our App Terms of Use, Section 8.

4. How We Use Information

We do not use your information for advertising, do not sell it, and do not build advertising or marketing profiles from it.

5. AI Processing & Sub-processors

To deliver Bob AI's capabilities, we engage a limited set of enterprise AI providers, each acting as our sub-processor under contracts that prohibit using your data for model training:

Only what's needed is sent. For any given request, Bob forwards only the relevant material — the specific document snippets retrieved for your question, the page being processed, or the sensor readings needed to answer. Your full document library and raw historian are never sent wholesale.

If your organization's procurement or security team needs a formal, standalone AI Privacy Policy document (with version history and a signature-ready format), one is in preparation — see our Legal page for status.

6. No AI Model Training on Your Data

We do not use your data to train AI models. Your documents, sensor data, and conversations with Bob AI are used only to answer your questions — never to train or improve any AI model, ours or a third party's. This applies equally to Perplexity when your organization enables optional web search. All three AI sub-processors in Section 5 operate under enterprise contracts that prohibit using your data for model training. We may separately use aggregated and/or de-identified data — which does not identify you, your organization, or any individual, and cannot be used to reconstruct your data — for analytics and Service-improvement purposes.

7. How We Share Information

We do not sell personal data and do not "share" it for cross-context behavioral advertising as defined under the CCPA/CPRA. We disclose personal data only: (a) to the service providers/sub-processors in Section 5; (b) to comply with law, respond to lawful requests, or protect rights, property, or safety; (c) in connection with a merger, acquisition, financing, or sale of assets, subject to confidentiality protections; and (d) with your direction or consent.

8. Cookies & Similar Technologies

Our public website uses essential cookies (required for the site and secure account administration to function, always active) and, where used, analytics/performance cookies (used only with your consent where required). The authenticated web portal separately uses strictly necessary session cookies and local storage to keep you signed in, remember your workspace settings, and maintain security — these are essential to the portal's operation and are not used for advertising or cross-site tracking. You can manage cookie choices through your browser settings; blocking some cookies may affect site or portal functionality. Where required, we honor opt-out preference signals such as Global Privacy Control (GPC) for analytics and cookie preferences.

9. Data Retention

Personal information we process may be stored and processed in your region, in the United States, or any other location where EQSeer LLC or our service providers operate.

We consider the following factors when determining how long we retain and store your information:

Within the Service, your organization's administrator can configure retention settings for your organization's Customer Data (documents, sensor data, conversations, and related records); when data is no longer needed, we delete or de-identify it, subject to legally required retention and routine backup rotation.

10. Security

We maintain administrative, technical, and physical safeguards designed to protect personal data, confirmed against EQSeer's current AI Privacy Policy content, including: token-based authentication with key rotation; encryption; least-privilege, role-based access controls; and per-customer tenant isolation — each organization is provisioned a separate database schema and file namespace, so one organization's data is never visible to another's instance of Bob AI. (We've deliberately kept the specific underlying database technologies out of this public-facing page — publishing the exact infrastructure stack is a minor but avoidable information-disclosure risk; that level of detail belongs in a security questionnaire response or the forthcoming AI Privacy Policy page shared under appropriate context, not an open web page. Let us know if you'd prefer it included here instead.) You control what goes into the Service and what gets removed — Bob AI can only see documents and data you choose to connect. Data-retention windows are configurable per customer, and records can be permanently deleted on request. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Report security concerns to privacy@info.eq-seer.com.

11. Your Rights

GDPR / UK GDPR (EEA / UK residents). You have the right to access, rectify, erase, restrict, or port your data; to object to processing based on legitimate interests or direct marketing; to withdraw consent at any time; and to lodge a complaint with your local supervisory authority (in the UK, the ICO).

CCPA/CPRA (California residents). You have the right to know/access, delete, and correct personal information; to opt out of sale/sharing — we do not sell or share personal information for cross-context behavioral advertising; to limit use of sensitive personal information (we use login credentials only to provide and secure your account); and to non-discrimination for exercising these rights. You may use an authorized agent.

PIPEDA (Canada). You have the right to access your personal information, challenge its accuracy, and withdraw consent (subject to legal or contractual restrictions), and may direct a complaint to the Office of the Privacy Commissioner of Canada.

We will take reasonable steps to verify your identity before acting on a request, and will respond within the timeframes required by applicable law. We do not charge a fee for exercising your rights unless permitted by law.

12. International Transfers

EQSeer is based in the United States, and personal data we process as controller/business is generally processed in the United States. All sub-processors listed in Section 5 are located in the USA.

For transfers of personal information from individuals in the European Economic Area (EEA), UK, and Switzerland to countries "not considered adequate" by their respective data protection regulators, to enable their privacy rights and protections to travel with their personal information, we rely on legal mechanisms and the use of other data protection measures. Such legal mechanisms include, but are not limited to, the standard contractual clauses published by the European Commission under Commission Implementing Decision 2021/914, and the International Data Transfer Agreement (IDTA) published by the UK Information Commissioner's Office. 13. Children's Privacy

Our website, app, and Service are directed to businesses and their personnel, not to children. We do not knowingly collect personal data from children under 16. If you believe a child has provided us with personal data, contact privacy@info.eq-seer.com and we will take appropriate steps to delete it.

14. Changes to This Policy

We may update this Policy from time to time for operational or legal reasons. We will revise the "Last updated" date above and, for material changes, provide additional notice as appropriate (for example, by email or an in-app/website notice). Your continued use of the Service after a change takes effect constitutes acceptance of the revised Policy, to the extent permitted by law.
